Is there a Demand for Arbitration form I can use?

No. If you want, a letter to Kaiser is sufficient. It should include the words “Demand for Arbitration,” your name, contact information: mailing address, phone number, and email, who the respondents are, and your claim for  damages. Please see OIA Rule 7.

How do I file a Demand for Arbitration against Kaiser?

You should mail your Demand for Arbitration to Kaiser’s legal department in the region where the incident occurred. Please see OIA Rule 7 and 8.

Can I represent myself in my case against Kaiser?

Yes. However, arbitration is a legal proceeding. You would need to know California law and represent yourself just as an attorney would. Also, if your case is for medical malpractice, under California law in almost all cases, you would need to hire a medical expert.

Can I have an attorney representing me in arbitration?

Yes. You are strongly encouraged to hire an attorney.

Can the OIA help me find an attorney?

No. If you need help finding an attorney, call the California State Bar and/or your local County Bar Association.

How much is the filing fee?

The filing fee is $150 and can be waived. Please see OIA Rule 12.

Do I have to include a filing fee with my Demand for Arbitration?

You can include a check for the filing fee with your Demand for Arbitration, but it is not necessary. Once the OIA receives your Demand for Arbitration from Kaiser’s legal department you will have seventy-five (75) days to pay the filing fee or to request a waiver of that fee.

Who do I make the filing fee check payable to?

Checks should be made payable to “Arbitration Account” and sent to the OIA at 635 S. Hobart Blvd., #A35, Los Angeles, CA 90005. Please do not make checks payable to Kaiser.

Is there a form for requesting a 90-day postponement pursuant to OIA Rule 21?

No. However, a request for a 90-day postponement must be in writing and sent to the OIA by mail, fax, or email.
